Halloran Trust Planning Proposal - Culburra Beach

The NSW Department of Planning and Environment (DPE) has presented a report to the NSW Independent Planning Commission (IPC) recommending that they refuse the state significant development application (SSDA) for residential development at West Culburra.

The documents provided by the Department are available on the Independent Planning Commission's website.

The IPC has advised Council that there will be a public meeting for this application before a decision is made, and this meeting will be held in or near Culburra. It is hoped that the state significant development application for a proposed golf course at Long Bow Point will be considered by the IPC at the same time. The report for the golf course report is not currently available.

Council staff are currently reviewing the Department's report and considering its significance for the Planning Proposal. Council may make a submission to the IPC in relation to the state significant development applications but has not yet determined what, if any, submission it will make.

Council has received advice from the NSW Department of Planning and Environment that the planning proposal for the Halloran Trust lands at Culburra Beach, Callala Bay and Kinghorne Point has been split into two planning proposals.

Council have engaged a consultant to conduct a groundwater investigation within the Halloran Trust Lands west of Culburra Beach. This investigation will determine the extent of the groundwater catchment of Lake Wollumboola within this site. The groundwater is monitored through a series of bore holes. These bore holes are fitted with equipment that transmits results each week to a website where the data is collected.

As part of its commitment to open and transparent governance, Council is making this data available to the public. The access details were emailed to all subscribers to the projects website on 17 January 2018. If you would like access to this data please email grant.rokobauer@shoalhaven.nsw.gov.au.

It will be approximately 2 years before a final report will be provided with conclusions on the meaning of the results provided.

Council's Development Committee resolved on 12 September 2017 to support splitting the Halloran Trust Lands Planning Proposal into two parts to allow the land at Callala Bay and Kinghorne Point to be progressed ahead of the land at Culburra Beach.

Contractors will commence drilling bore holes within the Halloran Trust Lands at Culburra today. These bore holes will be used to monitor groundwater to give us a better understanding of the Lake and its catchment.

The proposed changes to the Halloran Trust Lands PP to allow Callala Bay and Kinghorne Point to proceed ahead of Culburra will be considered by Council's Development Committee on 12 September, 2017.

The Development Committee Meeting will commence at 5:00 pm in the Council Chambers at the Nowra Administration Building.

Council is considering adjusting the Halloran PP so that it can be made as two separate plan amendments. This will be achieved by either an adjustment to the wording of the NSW Department of Planning’s Gateway Determination or by creating a new planning proposal for Callala Bay and Kinghorne Point.

The reasons for this are summarised below:

Reduce Delays for Callala Bay and Kinghorne Point

There is a complex water quality investigation being undertaken for the Culburra Beach site. This investigation is required to ensure that Lake Wollumboola is protected. This investigation will take a little over 2 years to complete. The investigation does not relate to Kinghorne Point and Callala Bay. Separating these sites will allow them to progress without having to wait the two years for this investigation.

Improve Community Consultation

The change will mean that there will be separate community consultation for Callala Bay and Culburra Beach. This means that both communities will get an equal voice in their part of the proposal. There is a risk that if the proposal remains consolidated that one community may be overshadowed by the other in the engagement process. There is also the potential for confusion as local communities try to sort through what information is and is not relevant to them. Splitting the proposal will also prevent any perception that one community or village is being disadvantaged to benefit the other.

We anticipate this change being considered by Council's Development Committee on 12 September 2017.

Council have engaged HGEO to conduct a groundwater investigation of the site to determine the extent of the groundwater catchment of Lake Wollumboola. The preliminary part of this investigation is complete and has determined that the following work is needed:

1.The Groundwater and Lake levels need to be monitored for 2 years

2.A soil and rock core needs to be taken and tested

This conclusion has been supported by the NSW Office of Environment and Heritage.

Council is currently organising the financing and logistics for the commencement of the monitoring and sampling so that the investigation can progress.

In April this year Council’s Development Committee resolved to support the Biodiversity Certification of the Halloran proposal.

This means that the proposal will be assessed in detail by NSW Office of Environment and Heritage and then sent to the NSW Minister for the Environment for sign off.

The proponent is currently undertaking additional investigations in relation to flora and fauna on the site as part of that process.
