45 Degree Rule Exemption for tree removal
The exemption will be renamed to ‘The Gordon Timbs 45 Degree Rule,’ and it will include a reference to native tree species list that could be used for replanting (non-mandatory).
The amendment is now in effect and our website has been updated to reflect the changes. To learn more about the Rule visit the Trees on Private Land page on our website.
45 Degree Rule
The 45 Degree Rule Exemption has been in place since 2004 and allows the removal of trees in urban areas without Council consent, subject to certain criteria.
Council is proposing amendments to the current 45 Degree Rule Exemption for tree removal in Shoalhaven Development Control Plan 2014 (DCP) to revert it back to the version (August 2023) that was in place prior to recent trial changes.
