45 Degree Rule Exemption for tree removal - Update
The public exhibition of the draft amendment to the 45 Degree Rule Exemption closed in November 2024.
The draft amendment (Amendment No. 57) was publicly exhibited for a period of more than 28 days, from 30 October to 29 November 2024. People were made aware of the opportunity to provide feedback on the draft amendment through Council's website, a media release, social media posts, and Council’s “Get Involved” page. The exhibition material was available both online and at Council's offices in Nowra and Ulladulla. Additionally, 24 Community Consultative Bodies and 54 industry stakeholders were directly informed of the exhibition.
A total of 414 submissions were received during the exhibition period, including three from community groups and six from tree removal operators (industry representatives).
Of the total submissions, 391 were received through the “Get Involved” page, while the other 23 submissions were provided through Council's Documents on Exhibition page or email.
Next Steps:
- All feedback received has been reviewed and noted
- A report will be submitted to Council at the Ordinary Meeting to be held on 11 March 2025 at the Shoalhaven City Council Chambers, Administrative Building Bridge Road, Nowra, commencing at 5.30pm. (Click here to access the report to be submitted).
The exemption will be renamed to ‘The Gordon Timbs 45 Degree Rule,’ and it will include a reference to native tree species list that could be used for replanting (non-mandatory).
